These Terms of Service ("Terms") govern your use of the website and services provided by Htown Media LLC ("Htown Media", "we", "us"), a digital advertising and marketing agency located in Houston, Texas. By accessing our website or engaging our services, you agree to these Terms.
Htown Media provides digital advertising management, website and landing page development, SEO, social media marketing, email marketing, content creation, and related consulting services. All services are subject to separate statements of work or proposals.
Important: We do not guarantee specific results, return on investment (ROI), ad placements, lead volume, conversion rates, or rankings. Advertising performance depends on many factors outside our control, including platform policies, competition, budget, creative quality, market conditions, and client execution. All results shared are illustrative only.
Clients are responsible for providing accurate information, timely feedback, necessary access (ad accounts, analytics, etc.), and compliance with all applicable laws and platform policies. We are not responsible for content you provide or approve.
Fees are outlined in proposals or statements of work. Payment terms are typically net 15 or as agreed. Late payments may result in suspension of services. Ad spend is managed on your behalf but remains your financial responsibility.
Upon full payment, you own the final deliverables created specifically for you. We retain rights to our methodologies, frameworks, and any pre-existing materials. We may use anonymized case studies and performance data for marketing purposes unless otherwise agreed in writing.
We treat your business information as confidential and will not disclose it to third parties except as necessary to perform services or as required by law.
To the maximum extent permitted by law, Htown Media’s total liability shall not exceed the total fees paid by you in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits or business opportunities.
Either party may terminate services as outlined in the applicable statement of work. Upon termination, you remain responsible for ad spend incurred and any outstanding fees.
These Terms are governed by the laws of the State of Texas. Any disputes shall be resolved in the state or federal courts located in Harris County, Texas.
We may update these Terms. Continued use of our services after changes constitutes acceptance of the updated Terms.
